Information collected through the Platform may be used in connection with Trust Scores™, professional rankings, risk classifications, predictive analytics, and market intelligence. Such services are governed by separate Trust Score & Risk Intelligence disclaimers.
8. How We Disclose Information
TrustBuild may disclose information to service providers, business partners, for legal compliance, corporate transactions, and business operations including affiliates, advisors, consultants, attorneys, and auditors.

9. User-Generated Content
Information submitted through reviews, ratings, comments, profiles, and public postings may become publicly available. Users are responsible for content they voluntarily disclose.
10. Marketing Communications
TrustBuild may send newsletters, promotional materials, product updates, and marketing communications. Users may opt out of marketing communications using provided unsubscribe mechanisms. Operational communications may continue.
10A. SMS Text Messaging Program (Professionals)
This section describes how TrustBuild handles SMS text messaging for professionals who opt in to receive project invitation alerts. This program is separate from general marketing email communications described in Section 10.
Program Name
TrustBuild Professional Project Invitation Alerts
Who May Receive SMS
Professionals who create an account on the Platform, provide a mobile telephone number during professional onboarding, and affirmatively opt in by checking an unchecked consent box before continuing.
Purpose of SMS
To send transactional text message notifications when a customer invites the professional to submit a proposal for a project. These messages are account-related service notifications, not promotional advertisements.
Information Collected for SMS
- Mobile telephone number provided during onboarding
- SMS consent status, consent timestamp, consent text version, and opt-in source
- Records of messages sent and delivery status where available
How SMS Information Is Used and Shared
- To deliver project invitation alerts you requested
- To maintain compliance records of your consent
- Shared with Twilio, our SMS delivery provider, solely to transmit messages you consented to receive
- Not sold or shared with third parties for their independent marketing purposes
Message Frequency and Charges
Message frequency varies based on project invitation activity. Message and data rates may apply depending on your mobile carrier plan.
Opt-Out and Help
You may opt out at any time by replying STOP to any TrustBuild SMS message. For help, reply HELP or contact privacy@trustbuildmiami.com.
Consent Is Not a Condition of Purchase
Consent to receive SMS project invitation alerts is not required to create an account or use the Platform, but SMS alerts will not be sent without opt-in consent.
11. Data Retention
TrustBuild may retain information as long as necessary for business purposes, to comply with legal obligations, to resolve disputes, to enforce agreements, for analytics purposes, and for historical recordkeeping. Retention periods may vary. TrustBuild may retain certain information even after account closure, including SMS consent records where required for regulatory compliance.
12. Data Security
TrustBuild employs commercially reasonable safeguards designed to protect information. However, no system is completely secure. TrustBuild does not guarantee absolute security, protection from cyberattacks, protection from unauthorized access, or prevention of data breaches. Users acknowledge inherent risks associated with internet technologies.
13. International Data Transfers
Information may be processed, stored, transferred, or accessed in jurisdictions outside the user's state or country. Users consent to such transfers.
14. Children's Privacy
The Platform is not intended for individuals under eighteen (18) years of age. TrustBuild does not knowingly collect personal information from children. If discovered, such information may be deleted.
15. User Rights
Subject to applicable law, users may request access to information, correction of information, deletion of information, data portability where required, and withdrawal of certain consents. TrustBuild reserves the right to verify identity before processing requests. Certain information may be exempt from deletion.
16. Public Records Disclaimer
TrustBuild may collect and process information obtained from public records. Information obtained from public records may remain available even if removed from the Platform. TrustBuild does not control government records.
17. Third-Party Links
The Platform may contain links to third-party websites. TrustBuild is not responsible for third-party privacy practices, third-party security practices, or third-party content. Users access third-party services at their own risk.
18. No Warranty Regarding Information Accuracy
TrustBuild does not warrant the accuracy, completeness, reliability, or timeliness of any information collected, stored, displayed, or processed.
19. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALL PRIVACY-RELATED SERVICES ARE PROVIDED "AS IS," "AS AVAILABLE," AND "WITH ALL FAULTS" WITHOUT WARRANTIES OF ANY KIND.
20. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY FLORIDA LAW, TRUSTBUILD GROUP LLC AND ITS MEMBERS, MANAGERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AFFILIATES, AGENTS, SUCCESSORS, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR DIRECT, INDIRECT, SPECIAL, CONSEQUENTIAL, INCIDENTAL, PUNITIVE, DATA LOSS, PRIVACY-RELATED, SECURITY, UNAUTHORIZED ACCESS, OR CYBERATTACK DAMAGES ARISING FROM USE OF THE PLATFORM.
21. Liability Cap
IF LIABILITY IS IMPOSED DESPITE THESE DISCLAIMERS, TRUSTBUILD'S TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF $100.00 OR THE TOTAL FEES PAID TO TRUSTBUILD BY THE CLAIMANT DURING THE SIX (6) MONTHS PRECEDING THE CLAIM.
22. User Assumption of Risk
Users voluntarily assume all risks associated with internet communications, data transmissions, online services, public postings, and technology systems.
23. Indemnification
Users agree to defend, indemnify, and hold harmless TrustBuild Group LLC and its members, managers, officers, directors, employees, contractors, and affiliates from claims arising from user content, user conduct, user violations of law, or user misuse of the Platform.
24. Governing Law
This Privacy Policy shall be governed exclusively by the laws of the State of Florida.
25. Arbitration
Any dispute relating to this Privacy Policy shall be resolved pursuant to the TrustBuild Arbitration & Dispute Resolution Agreement.
26. Class Action Waiver
Users waive any right to participate in class actions, representative actions, collective actions, or mass arbitration proceedings to the fullest extent permitted by law.
27. Time Limit for Claims
Any claim arising from this Privacy Policy must be initiated within one (1) year after the claim arises, to the fullest extent permitted by law.
28. Severability
If any provision is deemed unenforceable, the remaining provisions shall remain enforceable.
29. Modifications
TrustBuild reserves the right to modify this Privacy Policy at any time. Continued use of the Platform constitutes acceptance of modifications.
30. Entire Agreement
This Privacy Policy, together with the Terms of Service, Cookie Policy, Website Legal Disclaimer, Trust Score & Risk Intelligence Disclaimer, Professional Agreement, Customer Agreement, and Arbitration Agreement, constitutes the complete agreement regarding privacy and information practices.
