These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and TrustBuild Group LLC, a Florida limited liability company ("TrustBuild," "Company," "we," "us," or "our"), governing your access to and use of the TrustBuild website, platform, applications, products, and services.

By accessing, browsing, registering for, or using the TrustBuild platform, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with these Terms, you must not access or use the platform.

TrustBuild is a technology platform that connects customers, property owners, businesses, professionals, service providers, vendors, and other construction industry participants.

TrustBuild may provide:

• Professional matching services
• Lead generation services
• Project management tools
• Messaging and communication tools
• Professional verification information
• Permit and project intelligence
• Property and market data
• AI-powered recommendations
• Review and rating systems
• Subscription services
• Marketing and advertising services
• Construction intelligence and analytics

TrustBuild is not a contractor, subcontractor, architect, engineer, construction manager, insurance company, lender, broker, attorney, or professional advisor.

You must be at least eighteen (18) years old to use the platform.

By using the platform, you represent and warrant that:

• You are legally able to enter into binding agreements.
• Information you provide is accurate.
• You will comply with all applicable laws and regulations.

TrustBuild does not perform construction work.

TrustBuild does not:

• Build projects
• Manage projects
• Supervise professionals
• Guarantee workmanship
• Guarantee project completion
• Guarantee project costs
• Guarantee project timelines

Any contract for services is solely between the customer and professional. TrustBuild is not a party to any construction agreement.

TrustBuild may display:

• License information
• Insurance information
• Permit history
• Reviews
• Ratings
• Risk indicators
• Verification badges
• AI-generated scores

Although we strive to provide accurate information, TrustBuild does not guarantee accuracy, completeness, timeliness, or reliability. Users should independently verify all information before hiring a professional.

TrustBuild may utilize artificial intelligence, machine learning, predictive analytics, scoring models, and automated systems. These systems may generate professional recommendations, risk assessments, trust scores, cost estimates, market intelligence, and project insights.

Such information is provided for informational purposes only. TrustBuild does not guarantee the accuracy of AI-generated information. Users must exercise independent judgment.

Users may be required to create an account. You agree to:

• Maintain accurate information
• Protect your password
• Maintain account security
• Notify us of unauthorized access

You are responsible for all activities occurring under your account.

Professionals using the platform agree to:

• Maintain all required licenses
• Maintain insurance coverage
• Comply with applicable laws
• Provide truthful information
• Honor commitments made through the platform
• Maintain professional conduct

TrustBuild may suspend or remove professionals at its sole discretion.

Users may submit reviews, ratings, photos, videos, comments, and feedback.

You represent that:

• Your content is truthful
• Your content does not violate any law
• You own or have rights to submit such content

TrustBuild may remove content at its sole discretion.

Users may not:

• Submit false information
• Impersonate another person
• Violate laws
• Harass users
• Upload malicious software
• Attempt unauthorized access
• Manipulate ratings or reviews
• Scrape platform data
• Reverse engineer platform functionality

Violations may result in account suspension or termination.

Certain services may require payment. By purchasing services, you agree:

• To pay all applicable fees
• That fees may be recurring
• That fees may be non-refundable unless required by law

TrustBuild may modify pricing upon notice.

Payments may be processed through third-party payment providers. TrustBuild does not store complete payment card information. Users agree to the terms of applicable payment processors.

The platform may integrate with third parties including:

• Payment providers
• Mapping services
• Communication services
• Data providers
• Government databases

TrustBuild is not responsible for third-party services or content.

Program name: TrustBuild Professional Project Invitation Alerts

Professionals who opt in during onboarding may receive transactional SMS text messages when a customer invites them to submit a proposal for a project. Message and data rates may apply. Message frequency varies based on project invitation activity.

You may opt out of SMS project invitation alerts at any time by replying STOP to any TrustBuild text message. For assistance, reply HELP or contact info@trustbuildmiami.com.

Full SMS privacy and data practices are described in Section 10A of our Privacy Policy.

All platform content including logos, branding, software, databases, text, graphics, designs, and analytics are owned by TrustBuild Group LLC or its licensors. No ownership rights are granted to users.

Your use of the platform is also governed by our Privacy Policy. By using the platform, you consent to the collection and use of information as described in our Privacy Policy.

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRUSTBUILD DISCLAIMS ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AND AVAILABILITY.

WE DO NOT GUARANTEE THAT:

• THE PLATFORM WILL BE ERROR FREE
• PROFESSIONALS WILL PERFORM SATISFACTORILY
• PROJECTS WILL BE COMPLETED
• RESULTS WILL MEET EXPECTATIONS

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRUSTBUILD GROUP LLC SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL DAMAGES, LOST PROFITS, LOST REVENUE, OR LOST DATA.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF:

• $100.00 USD, OR
• THE AMOUNT PAID TO TRUSTBUILD DURING THE PRECEDING TWELVE (12) MONTHS.

You agree to defend, indemnify, and hold harmless TrustBuild Group LLC and its owners, officers, employees, affiliates, and agents from claims arising from your use of the platform, your content, your violation of these Terms, or your violation of applicable law.

Any dispute arising from these Terms shall first be addressed through good-faith negotiations. If unresolved, disputes shall be resolved through binding arbitration in Miami-Dade County, Florida. Each party waives the right to a jury trial.

Users agree that claims shall be brought solely in an individual capacity. No class actions or representative actions may be maintained.

These Terms shall be governed by the laws of the State of Florida, without regard to conflict-of-law principles.

TrustBuild may suspend or terminate access at any time for any reason, including violations of these Terms. Termination does not relieve users of obligations accrued before termination.

TrustBuild may modify these Terms at any time. Updated Terms will be posted on the platform with a revised Effective Date. Continued use of the platform constitutes acceptance of revised Terms.
